1. Basic Provisions

1.1 These Terms and Conditions govern the rights and obligations between Rybářství Schönfeld s.r.o., registered office: Vyskočilova 1410/1, Michle, 140 00 Prague 4, Company ID No.: 09350250, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 334929 (hereinafter the “Provider”), and the customer who concludes a contract for the provision of services via the website available at www.jezerolenesice.cz (hereinafter the “Customer”).

1.2 These Terms and Conditions apply in particular to the provision of services related to recreational fishing and other leisure activities via the online e‑shop interface available at www.jezerolenesice.cz.

1.3 The contractual relationship between the Provider and the Customer arises upon the conclusion of a service contract based on a binding order placed by the Customer and its confirmation by the Provider.

1.4 These Terms and Conditions form an integral part of the service contract. Any deviating arrangements agreed in the contract take precedence over these Terms and Conditions.

1.5 The Provider may unilaterally amend or supplement these Terms and Conditions. The new version becomes effective on the day it is published on the website unless expressly stated otherwise. Changes do not affect rights and obligations that arose while a previous version was in effect.

1.6 All communication between the Provider and the Customer takes place by e‑mail. The Provider’s contact e‑mail is: info@jezerolenesice.cz.

1.7 Detailed information on the protection and processing of personal data is provided in the Privacy Policy available on the Provider’s website.

2. Orders

2.1 The Customer may place orders for services without registration directly via the Provider’s web interface.

2.2 When placing an order, the Customer must provide true, accurate, and complete information. In the event of any change, the Customer must promptly update this information in their user account.

3. Concluding the Service Contract

3.1 The Provider’s web interface contains an overview of currently available fishing piers and accompanying services (e.g., equipment rental). Each service or item is listed with the current price including VAT. The offer and prices remain valid for as long as they are displayed on the web interface. This does not preclude the Provider from agreeing individual terms.

3.2 To make a reservation, the Customer selects a free date for a fishing pier (e.g., a pier No. 1), specifies the number of fisherman (anglers and accompanying persons), and confirms the selection by clicking “Book now”. The Customer is then redirected to select accompanying services, which can be added to the order (including accompanying persons). The order is then confirmed by clicking “Confirm”.

3.3 Before submitting the order, the Customer may check and edit all information entered into the order, including correction of any errors (by symbol of pencil in the Reservation summary). The order is submitted by clicking “Confirm reservation” or another similarly labelled button. The information in the order is deemed correct by the Provider.

3.4 Immediately after receiving the order, the Provider sends the Customer a notification confirming receipt to the e‑mail address provided by the Customer. The service contract is concluded at the moment this confirmation is delivered and is conditional upon payment of the price for the reserved services to the Provider’s account.

3.5 If the Provider cannot fulfil any of the requirements in the order, the Provider will inform the Customer by e‑mail and send a proposal for a new contract. This contract is concluded when the Customer confirms acceptance of the Provider’s proposal by e‑mail.

3.6 If the Customer requests a change to the order, the Customer shall send a new order to the Provider’s e‑mail. This new order is considered a new proposal for a contract; the original contract is cancelled and a new one arises upon the Provider’s confirmation, if circumstances permit (e.g., availability of the spot/service).

3.7 All confirmed orders are binding on the Customer. The Customer may cancel an order only until the confirmation of its receipt by the Provider has been delivered.

3.8 The Customer acknowledges that the Provider is not obliged to conclude a contract, especially with persons who have materially breached their obligations under contracts or these Terms and Conditions in the past.

3.9 Costs incurred by the Customer in connection with the use of means of distance communication (e.g., internet connection, telephone calls) are borne by the Customer.

4. Payment Terms

4.1 The Customer must pay the Provider the price for reserving a fishing piers and for ordered services by cashless transfer to the Provider’s account stated in the order confirmation. Payment may also be made via a QR code, if this option is available on the website or in the order confirmation.

4.2 Payment must be made with the correct variable symbol provided to the Customer in the order confirmation. The price is deemed paid at the moment the full amount is credited to the Provider’s bank account.

4.3 If a gift voucher in a monetary value is purchased stating a number of days or a type of service, the Customer acknowledges that prices for specific services may change during the voucher’s validity. If the value of the voucher is insufficient to cover the reservation, the Customer (or the recipient) must pay the price difference.

4.4 Where customary or required by law, the Provider will issue a tax document – invoice – for the payment received. The invoice is sent to the Customer electronically to their e‑mail address no later than 10 days after receipt of payment.

5. Withdrawal from the Contract and Cancellation Policy

5.1 The Customer acknowledges that, pursuant to Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, as amended, there is no right to withdraw from the contract within 14 days if the subject of the contract is the provision of a leisure service on a specific date.

5.2 The Customer may cancel their reservation; in such a case a cancellation fee is payable. The amount of the cancellation fee is as follows:

  • 14 to 0 days before the start date: the cancellation fee is 100% of the reservation price (the amount is non‑refundable).

5.3 A request to cancel a reservation (withdraw from the contract) must be sent by email to: info@jezerolenesice.cz. The Customer must state their name, order number, bank account for any refund, and the reservation date in the request.

5.4 Upon receiving the request, the Provider will assess the Customer’s entitlement to a partial refund of the amount paid (e.g., in the case of timely withdrawal or exceptional circumstances) and will inform the Customer without delay.

5.5 If the Customer requests a change of reservation, the original contract may—by mutual agreement—be replaced with a new one. The value of the original reservation will be transferred to the new one; any price difference will be paid by the Customer to the Provider’s account. There is no legal entitlement to a change of reservation.

6. Complaints and Liability for Services Provided

6.1 The Customer has the right to make a complaint if the services provided were not delivered in the agreed scope, quality, or on the agreed date.

6.2 A complaint must be lodged without undue delay, no later than 7 days after the service is provided. Complaints must be submitted in writing by e‑mail to info@jezerolenesice.cz and must include identification of the order, a description of the defect, and the requested method of resolution.

6.3 The Provider will handle the complaint no later than 30 days from its receipt, unless the parties agree otherwise. The Customer will be informed of the outcome by e‑mail.

7. Personal Data Protection

7.1 The Provider processes Customers’ personal data in accordance with applicable legislation, in particular Regulation (EU) 2016/679 (GDPR).

7.2 Data are processed solely for the purpose of processing orders, reservations, and performing the contract. Further processing (e.g., marketing) takes place only with the Customer’s explicit consent.

7.3 Details of personal data processing are set out in a separate Privacy Policy available on the Provider’s website.

8. Out‑of‑Court Consumer Dispute Resolution

8.1 If a dispute arises between the Provider and the Customer – consumer, which cannot be resolved by mutual agreement, the Customer has the right to contact the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, website: www.coi.cz, which is competent for out‑of‑court consumer dispute resolution.

8.2 Disputes can also be resolved online via the EU dispute resolution platform available at: https://ec.europa.eu/consumers/odr.

10. Effectiveness of the Terms

10.1 These Terms and Conditions take effect on: 1. 8. 2025.

10.2 The Provider reserves the right to amend the Terms and Conditions. The new version will be published on the website and takes effect on the date of publication, unless stated otherwise.

11. Final Provisions

11.1 All contractual relationships between the Provider and the Customer are governed by the laws of the Czech Republic. If a contractual relationship established by a service contract contains an international element, the parties agree that the relationship is governed by the laws of the Czech Republic. This does not affect consumer rights granted by generally binding legal regulations in the country of the consumer’s habitual residence.

11.2 All rights to the Provider’s website, in particular copyrights to the content (including texts, graphics, photographs, videos, page layout, trademarks, logos, and other elements), belong exclusively to the Provider. Any copying, distribution, modification, or other use of these elements without the Provider’s prior written consent is prohibited.
